Tax Evasion

Tax Evasion

“The power to tax involves the power to destroy.” - John Marshall, Chief Justice of the U.S. Supreme Court

At the Jacobs Law Firm, we are passionate about defending individuals and businesses targeted by the IRS and state tax authorities.  When it comes to tax-related investigations and prosecutions, our expertise is second-to-none.

As a federal prosecutor, Matt Jacobs worked closely with IRS Special Agents to investigate and prosecute violations of federal tax law.  That experience gave Matt unique insight into how tax cases are built and presented – as well as an understanding of the substantive, procedural and evidentiary vulnerabilities often present in these cases.

Our experience has taught us that in tax matters, the line between civil errors and criminal misconduct is often difficult to discern.  And we know that evidence establishing purposeful evasion – as opposed to unintentional or negligent underreporting – is often circumstantial, witness-dependent or otherwise susceptible to attack by skilled and experienced defense attorneys.

We also know that the IRS makes mistakes, sometimes big mistakes, and we have used forensic accounting to successfully uncover serious flaws in IRS computations – discoveries which have resulted in reduced criminal exposure, the elimination of fines, and significant tax savings for our clients.

In recent years, examples of the weaponization of the IRS have proliferated at a disturbing rate, and the 2022 federal law authorizing the creation of 87,000 new IRS employees will only serve to increase the number of investigations, audits and prosecutions in the years to come.

Our extensive courtroom experience gives us the confidence to take even the toughest tax cases to trial.  But that experience also helps us determine when it is in our client’s best interest to consider a plea agreement.  And our exceptional track record of success at trial gives us tremendous leverage when it comes to negotiating pleas.
